1. Scope
Applies to content displayed on 5emaker.com (Site pages, blog posts, sample outputs), content generated by users through our AI tools, and content saved by users to their accounts. We comply with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512).
2. Submitting a Takedown Notice
Send a written notice to dmca@5emaker.com including:
Required Elements (17 U.S.C. § 512(c)(3))
- Identification of the copyrighted work: title, registration number (if applicable), publication date, and a link or copy of the original.
- Identification of the infringing material: URL for site content; URL or user account email for user-generated content; for AI-generated outputs, the specific output and how it infringes (stylistic similarity alone is generally not infringement).
- Your contact info: full legal name, mailing address, phone, email.
- A statement of good faith belief that the use is not authorized.
- A statement under penalty of perjury that the info is accurate and you are authorized to act on the owner's behalf.
- Your physical or electronic signature.
3. Our Response
- We acknowledge receipt within 3 business days.
- If valid and complete, we remove or disable access within 10 business days.
- We notify the user who uploaded/generated the content (with your contact info redacted where reasonable).
- We may terminate accounts of repeat infringers (DMCA § 512(i)).
4. Counter-Notification
If your content was wrongly removed, submit a DMCA Counter-Notice to dmca@5emaker.com including:
Required Elements (17 U.S.C. § 512(g)(3))
- Identification of the removed material and prior location.
- A statement under penalty of perjury of good faith belief the removal was a mistake or misidentification.
- Your contact info: full legal name, mailing address, phone, email.
- A statement consenting to jurisdiction of the federal court where you reside (or, if outside US, federal court in Wyoming, USA), and accepting service of process from the original complainant.
- Your signature.
We forward to the complainant and restore content within 10-14 business days unless they file a court action.
5. Special Note on AI-Generated Content
Most AI-generated content is original output based on user prompts. AI systems are imperfect and may produce content that closely resembles copyrighted works or reproduces WotC proprietary names despite our content filters.
If you identify infringing AI-generated content, submit a DMCA notice per Section 2. We treat WotC IP claims with the same seriousness as any other copyright holder.
Our compliance commitments:
- Multi-layer content filters (input + system prompt + output) minimize WotC proprietary content.
- We maintain logs of infringement attempts and tune our filters.
- We remove infringing public-facing content within 10 business days of valid notice.
6. False Claims
Submitting a false DMCA notice may result in liability for damages under 17 U.S.C. § 512(f), including costs and attorney's fees.
Do not submit if you do not own the copyright, if the use is likely fair use or public domain (e.g., SRD 5.1 under CC-BY-4.0), or if you are using DMCA as a censorship tactic.
7. Repeat Infringer Policy
Per DMCA § 512(i), we terminate accounts of users who receive 3 or more substantiated DMCA notices within a 12-month period.
8. Trademark Complaints
For trademark infringement (not copyright), contact legal@5emaker.com.
